Political Prelude

A word of caution, I have never taken a course in politics, these ideas are the result of discussions and or what I think should be self evident.

Throughout history there have been great human atrocities and they are often attributed to a few or even one bad person. However, most if not all of these great atrocities could not have happened without a complicit or errant hierarchy of power. Hence, a just constitution should define the structural restrictions of government in a way that precludes usurpation of power by one or even a few individuals. Further, the legitimate acts of coercion should be restricted in their application to the mediation of disputed responsibility. The fallacy that a few should control the power of the many in order to protect the citizenry in times of need is predicated on an unprepared and ignorant populace.

In an ideal world there is the contention that an individual should not be restricted in any fashion from any activity that does not adversely affect the actions of another. This concept is well known and often explained with the statement “your right to swing your fist ends at my nose”.

The creation of government should be an attempt to create a framework in which the majority of people are accepting of their role and minimization of abuse by or to those who do not accept their role. Also, there should be the explicit goal to minimize corruption or the possibility of usurpation of power as well as inefficiency. Further consider that many of the structural possibilities that promote efficiency also allow for corruption. Thus it seems reasonable to sacrifice some efficiency in order to curtail corruption.

Since a government is nothing more than a body of rules by which the majority should willingly abide and the minority accept by enforcement, the primary means to satisfy the above goals should be in the way that those rules are created and enforced. Further, since the morals and goals of people change over time, government and its body of rules should also evolve to reflect the nature of those changes. It is in human nature that an individual will attempt to enforce rules in a manner that will most benefit themselves, thus any rule must not only specify its limits but how those limits are applied and must do so in a manner consistent with maximizing personal freedom and the minimization of corruption and inefficiency.

What follows is the attempt to create an evolutionary meritocratic framework for a government that embodies the above ideals.

The Will of the People

Any person1) that chooses to abide by this instrument with discretion2) shall be granted admission to Citizen status and endowed with protection of all the rights and accountable for all of the responsibilities herein. Under this instrument it is decreed that the following are fundamental;

  • Every Citizen shall have the inalienable right to pursue that which they need to sustain their own life and that which they need to sustain the life of their wards.
  • Every Citizen shall have the responsibility not to interfere with the life sustenance of another person.
  • Every Citizen and their wards shall have the right and responsibility of education, for without understanding there can be no accountability.
  • Every Citizen shall be wholly accountable - for their intentional actions, for the foreseeable actions of their wards, and for the deliberate actions of any collective of which they are a member - in accord with this instrument and The Rule of Law.
  • Every Citizen shall have the right to any pursuit without government interference, until their pursuits can be proven to have affected another person in a manner that contravenes this instrument or The Rule of Law.

Governmental Structure

Government shall only consist of two forms of Assembly. Without exception each Assembly shall consist of a Judicial Branch and a Legislative Branch or a Judicial Branch and an Executive Branch. The Judicial Branch shall review, record and suggest all actions with regard to this instrument and in accordance with the Agreement of the Majority. The Legislative Branch shall maintain the body of The Rule of Law in accordance with the suggestions of the Judicial Branch and the Agreement of the Majority. The Executive Branch shall enjoin accountability with regard to this instrument in accordance with suggestions of the Judicial Branch and the Agreement of the Majority. Governmental Assembly shall be the sole means by which the government may act. Governmental Assembly may only form in order to address a singular concern of an Agreement of the Majority.

Governmental Assembly members shall be chosen at random from the combined relevant candidates, with the exception that the Assembly members shall be chosen to minimize their time served in Assembly. The body of relevant candidates shall be comprised of qualified Citizen volunteers. A candidate is considered qualified when they either satisfy all of the following criterion - the candidate is sufficiently well educated in the subject of the Assigned objective, the candidate submits a binding statement of intention in agreement with the singular objective of the Assembly and the candidate has no history of malfeasance - or they are supported by an Agreement of the Majority. An assembly member may be reimbursed for their time in Assembly subject to the approval of the ratifying Agreement of the Majority.

The Agreement of the Majority is defined while the following conditions of the Citizens opinions are true. A Citizen may only hold one officially recognized opinion on any given subject. An opinion is a certified and conscientious record made by a living Citizen that may be modified by the Citizen, and only by the Citizen, at any time. The currently counted supporting opinions must number no less than half of the number of Citizens in the Region of Accountability. The currently counted supporting opinions must be no less than twice the number of currently dissenting opinions in the Region of Accountability. The count of the Citizens opinions shall be made from the opinions of the Citizens currently within the Region of Accountability. Every Citizen who's opinion is being assessed in an Agreement of the Majority shall be informed of such and allowed to clarify their opinion before ratification of the Agreement of the Majority. The Region of Accountability shall be the current minimally bounded region that encompasses the Citizens and their immediate concerns.

Governmental Authority must abide by the following;

  • Governmental Authority shall have no power except as explicitly granted by this document.
  • Governmental Authority shall only be executed by Governmental Assembly.
  • Governmental Authority must give every Citizen in the Region of Accountability of a newly ratified law a reasonable opportunity to leave the Region of Accountability before the Citizen may be held accountable to the newly formed law.
  • Governmental Authority may only be exercised over the body of Citizens in the Region of Accountability formed by the respective ratifying Agreement of the Majority.

Governmental Assembly must abide by the following;

  • Governmental Assembly is required to regulate the pursuits of a Citizen in order to;
    • preserve the rights of other Citizens.
    • enforce a Citizens accountability with regard to The Rule of Law.
  • Governmental Assembly must cause to exist an immediate and durable record of all deliberations and activities it performs.
    • All Government records shall be made available in full and unobfuscated for public review upon disassembly of the records generating governmental body.
    • All Government records in existence for the duration of one generation shall be made available for public review in full and unobfuscated.
    • All Government records shall be made available in full and unobfuscated for public review upon creation, unless a contravening rationale that is consistent with this document and The Rule of Law is made available for immediate public review.
    • Any Government records may only pass out of existence after they have been made available for public review in full and unobfuscated for the duration of one generation and their passing must be in accord with The Rule of Law.
  • Governmental Assembly must have the conclusion of all deliberate actions ratified by an Agreement of the Majority.
  • Governmental Assembly must be disassembled when so decreed by an Agreement of the Majority.
  • Governmental Assembly must be disassembled when it has completed the assigned objective.
  • Governmental Assembly shall be considered a collective in regard to its rights and responsibilities.
  • Governmental Assembly shall be the only body authorized to retroactively enjoin a Citizens accountability to The Rule of Law.
  • Governmental Assembly shall use the fewest of the currently available resources necessary to achieve its objective.

The Rule of Law must abide by the following;

  • Every article of The Rule of Law must be in accord with this instrument.
  • Every article of The Rule of Law must be ratified by an Agreement of the Majority.
  • Every article of The Rule of Law must be made available for public review in full and unobfuscated for the duration of its existence.
  • Every article of The Rule of Law must be logically consistent with the existing body of The Rule of Law.
  • Every article of The Rule of Law must be semantically unambiguous.
  • Every article of The Rule of Law must specify the exact conditions under which it shall be applied.
  • Every article of The Rule of Law must specify the exact manner in which it shall be enjoined.
  • Every article of The Rule of Law must eschew ordaining means of compliance.
  • Every article of The Rule of Law must specify a metric of compliance efficacy.
  • Every article of The Rule of Law must specify and meet a metric of its own objective efficacy.
  • Any article of The Rule of Law must cease to exist when fails to meet any of the afore mentioned criterion.
  • Any article of The Rule of Law must cease to exist when it is invalidated by an Agreement of the Majority.

Normative Taxation

A fixed amount of currency shall be created each year in behalf of each Citizen according to the average expected annual effort of a Citizen as determined by the reported annual efforts of all Citizens in the preceding duration of one generation. This per Citizen amount shall be the maximum available for expenditure by the government. Further the value of each Citizens allocation shall be moderated according to the product of the normalized intra and inter social review of each Citizen and shall proportionately spent according to each Citizens wishes. The intra social review of the Citizen shall be determined by a statistically significant random sampling of opinions regarding the Citizen collected from any organization of which the Citizen is a part. The inter social review of the Citizen shall be determined by a statistically significant random sampling of opinions regarding the organization(s) collected from any Citizens outside of the organization(s) of which the Citizen is a part. In the case where the Citizen is not a member of any organization the Citizen may remit their own estimation of their intra social review.

The Standard Currency of the Citizenry

  • The Government shall issue only a singular physical form of The Standard Currency.
    • The Standard Currency shall be engineered to last, under typical circumstances, as long as the average Citizens life.
  • The Government shall render useless as currency all of The Standard currency that it receives.

In all interpretations and all actions of Government the Agreement of The Majority shall hold final and absolute authority, except modification of this instrument, which may only be modified by consensus of all Citizens.
